REPRESENTATIVE ENGAGEMENTS:

 

  • Representing a director of corporations with international shareholders against a managing minority shareholder in an action alleging misappropriation of corporate assets and unlawfully earned profits involving real estate valued in the tens of millions of dollars.  Defeated a motion to dismiss and obtained significant disclosure after extensive motion practice and appeals.  Also obtained an order directing the defendant to hold $51,000,000 of assets in reserve.
     

  • Representing residents of a resort community in challenging an overly restrictive short term rental law.  The action alleges violations of the equal protection and due process clauses of the U.S. Constitution and the New York State Constitution, the U.S. Fair Housing Act, the U.S. Civil Rights Act, and the New York State Human Rights Law.
     

  • Represented the interests of a foreign banks in a federal bankruptcy proceeding involving international assets worth approximately $1,500,000,000.
     

  • Obtained dismissal of an action based on a mandatory arbitration clause and obtained an order directing that the record be sealed.          

  • Strategically positioned an action for an advantageous settlement of adverse claims to a $1,500,000 life insurance policy.

Counsel to Court Appointed Guardians and Receivers

 

Aimee Levine Law LLC counsels court appointed guardians with respect to a variety of issues, including asset management, Medicaid planning, and the preparation of trusts and other financial instruments, as well as representing them in court.  The firm also counsels court appointed receivers, representing them in court and in real estate management and recovery.

REPRESENTATIVE ENGAGEMENTS:

 

  • Strategically positioned an arbitration proceeding, instituted by a cooperative corporation seeking over $200,000 in legal fees and interest against an incapacitated person, for an amicable resolution.
     

  • Obtained court authorization the establish a revocable trust for the benefit of an elderly incapacitated person.
     

  • Obtained court authority to revoke a health care proxy naming the incapacitated person’s home health aide as her health care agent and directing the aide to turn over all documents belonging to the incapacitated person.   Also advised the guardian with respect to the proper management of assets.
     

  • Successfully represented a court appointed receiver in selling a brownstone notwithstanding significant title issues and multiple actions, motions and appeals that were instituted to block the sale.  Obtained significant relief in court regarding the management of the property.
     

Real Estate

Aimee Levine Law LLC advocates for its clients in real estate transactions from the commencement of negotiations through closing, zealously representing their interests with banks, brokers, appraisers, cooperative corporation’s boards and title companies.  The firm represents both buyers and sellers of cooperative and condominium apartments and single family residences.  The firm has also successfully represented a cooperative corporation in having a guardian appointed for an incapacitated shareholder, and counsels property owners with respect to commercial tenants.
